Whistleblowing
Marstrands Havshotell is committed to being free from misconduct, corruption and other serious irregularities. It is important to us that anything which may harm the business or our employees is identified and addressed as early as possible.
We therefore provide a whistleblowing function where you can report work-related concerns.
WHAT IS WHISTLEBLOWING?
Whistleblowing is when a person reports serious misconduct within an organisation. This may include illegal or unethical behaviour.
Since 17 December 2021, Sweden has a new Whistleblowing Act (2021:890) on the protection of persons who report misconduct.
WHO CAN REPORT?
In addition to employees of Marstrands Havshotell, others are also protected under the Whistleblowing Act. This includes job applicants, interns, agency staff, consultants, and others who have obtained information about Marstrands Havshotell in a work-related context.
Contractors, subcontractors and suppliers who become aware of misconduct within the company may also report.
It does not matter if your work-related relationship with us has ended or has not yet begun – you are still entitled to report concerns.
The protection also applies to individuals connected to the reporting person, such as those who assist them, as well as legal entities associated with them.
WHAT CAN YOU REPORT?
The matter you report must concern misconduct or irregularities at Marstrands Havshotell that you have become aware of in a work-related context.
To be protected under the law, the issue must be of public interest. This generally does not include individual employment or workplace disputes.
Examples of matters of public interest include tax offences, corruption or generally unethical conduct.
You must also have reasonable grounds to believe that the information you provide is true.
CONFIRMATION AND FEEDBACK
All reports submitted through the whistleblowing function are handled confidentially by a designated case handler at Marstrands Havshotell.
You will receive confirmation within seven days that your report has been received.
Within three months, you will receive feedback on the actions taken in response to your report.
If you choose to remain anonymous, you will not receive confirmation or feedback.
RETALIATION
Marstrands Havshotell does not tolerate any form of retaliation against individuals who report concerns in accordance with this policy. This includes dismissal, discrimination or harassment as a result of whistleblowing.
CONFIDENTIALITY
The information you provide, including your identity, is protected under the Swedish Public Access to Information and Secrecy Act (2009:400).
This means that the information will not be disclosed and will only be accessible to those who need it to investigate the matter.
PROCESSING OF PERSONAL DATA
When you report a concern, Marstrands Havshotell needs to process your personal data in order to receive your report, communicate with you during the process, follow up on the matter and provide feedback.
Your data will be archived and stored for up to two months after the case has been closed, or longer if necessary.
EXTERNAL REPORTING
We encourage you to report concerns internally in the first instance. However, if this is not possible or appropriate, external reporting is also an option.
The Swedish government has designated authorities to receive, follow up and provide feedback on reports through external reporting channels.
You may report directly to an external authority without first using the internal reporting channel.
